VAWA

If you are the spouse, parent, or child of a U.S. citizen or permanent resident and you have suffered abuse, mistreatment, or extreme cruelty by him and you have good moral character, you can apply for this benefit and get a path to residence. 

The victim can make this request on their own without the help or consent of the offender.
